As I sat down to complete the analysis of California Code of Civil Procedures, Section 527.6, which I will get to forthwith, I wrote an additional paragraph that will be included in my opening statement to the Court, which I believe makes perhaps the most important point of all.  I should be finished with the aforementioned analysis sometime this evening.  Of course, it is a good idea for both of us to think through this in a rational manner.
Your Honor, if Sean Prophet was living a quiet life, building a career, raising a family, and simply wanted to be left alone, wanted to leave the past behind, and simply move on, that would be one thing.  Perhaps he would have more cause to feel that I was "harassing" him under those conditions.  But those are not the conditions that exist.  The key feature of this situation is the fact that Sean Prophet has chosen to make himself into Public Enemy No. 1 as far as our church is concerned.   He is publically making the effort every day to assassinate the character of his own parents, the church founders, and the church itself, and the belief systems they have bequeathed to the world.  That's the primary point that fundamentally characterizes this situation.  He has chosen, willfully, consciously, and I would say maliciously, i.e. with malice, to be a thorn in the side of this church.   He has a right to do that of course.  But I would argue that it is improper for him to try to use the power of the State Government to bar members of this church from using their free speech rights to try pull that thorn out.
